At the time of ordering, the customer acknowledges that they have read the terms and conditions set out below and that they accept them without reservation.
 

Offers and prices

The prices of our products are displayed in euros including all taxes. LAB SAS reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in force at the time when you confirm your order. The products remain the property of LAB SAS until the full purchase price is paid.
Our offers are valid subject to availability of stock.

The offer extends to mainland France and Corsica. You declare that you have read and agreed to these Terms and Conditions of Sale before placing your order. Confirmation of your order therefore indicates acceptance of these Terms and Conditions of Sale. Barring proof to the contrary, the data recorded by terre-de-bougies.com constitutes proof of all transactions carried out by LAB SAS and its customers.


 

The ordering process/availability

Our product offers are valid while they are visible on the website, subject to availability of stock excluding promotional operations described as such on the websites. If a product should prove to be unavailable after you have placed an order, we will inform you by email or telephone. Your order will be automatically cancelled and your bank account will not be debited.

Your order is processed as soon as the payment is made. Please see the corresponding section for payments by cheque.

 

Online payment

Online payment on the website is secured by the SSL protocol.

Payments by bank cards are fully secured via the SSL protocol. In partnership with CIC, we use the latest encryption technologies to ensure that your payments are completely secure. Your banking information is neither stored nor visible on our servers.

All orders confirmed by the consumer imply irrevocable acceptance of the terms and conditions of sale which cannot be challenged.

 

Payment default

LAB SAS reserves the right to refuse to carry out a delivery or to honour an order placed by a consumer who has failed to pay for a previous order in whole or in part or with whom there is an ongoing payment dispute. The company reserves the right not to accept an order originating from a dubious or unidentifiable source.

Availability of products
The great majority of products offered on terre-de-bougies.com are available in our warehouses. We have selected products offering the best value for money from the best manufacturers, some of which are produced in limited quantities. If a product offered on the website should prove to be out of stock, we will contact you to inform you, offer you a new delivery time or an equivalent replacement product. You also have the option to request cancellation of your order or a refund.

 

Delivery methods - Mainland France

Orders received before noon are processed on the same day and shipped within 48 hours. The delivery period stated is based on the shipping date of the goods. Saturdays, Sundays and public holidays should be added to the delivery period. (Local public holidays in Alsace - Good Friday and Boxing Day). Order and delivery tracking information is available on the website.

In the event of a delay in shipping, you will be sent an email to inform you of any modification to the deliver-by date that you were given. In the event of a delay in delivery, we will offer you a new delivery date by email. In any event, in accordance with legal provisions, in the event of a delay in delivery of more than 7 days, you have the option to cancel your order within 60 working days. In this case, if you have received your products, after your cancellation, we will proceed with a refund of the product and the outward delivery costs, when we have received the product, complete and in its original condition.

 

Checking the parcel upon receipt

When you receive your parcel, you must check its general condition.

You must notify the transporter and LAB SAS of any reservations about the product delivered (e.g. damaged parcel, already opened, etc.). If the products are damaged, we advise you to refuse the delivery and we will send you a new replacement product.

Returns of defective products are carried out at the cost and risk of the customer. Any damage to the goods caused by inadequate packaging will not engage the liability of the LAB SAS company. You are strongly advised to wrap returned products securely in bubble wrap and to include a copy of the purchase invoice. Goods returned incomplete, damaged, broken or soiled by the customer will not be accepted and will be returned to the customer at their cost. Products returned on a carriage forward basis will be systematically refused.

After intervention by the after-sales service, return of the goods to the customer will be carried out at our cost. If it should transpire that the goods returned have not been subject to an authorisation to return and/or that the defect is not be covered by the guarantee, they will be returned to the customer on a carriage forward basis.

Damage caused by impact is not covered by the manufacturer's guarantee.
 

Your Invoice

You can print your invoice by going to "My account", "My orders" and then clicking on the reference for your order.
 

Withdrawal / return conditions

In accordance with current legislation on distance selling, you have a 14-day withdrawal period from the date of receipt of the parcel, in this case you will receive a refund or the product will be exchanged. Products must be returned in their original packaging and in perfect new condition with no scratches or signs of wear. Returns should be sent in their original packaging, complete and accompanied by a copy of the purchase invoice. When the 14-day period expires on a Saturday, Sunday or public holiday or non-working day, it is extended to the next working day.

In accordance with article L121-21 of the French Consumer Code, the Customer has a period of fourteen (14) clear days from the date of receipt of the products, except for the purchase of certain goods or services particularly, according to article L121-21-8 of the French Consumer Code:

"The right to withdrawal cannot be exercised for contracts: (...)

1° For the supply of services fully carried out before the end of the withdrawal period and the execution of which began after prior express agreement by the consumer and express relinquishment of their right to withdrawal;

(...) 3° For the supply of goods made to the consumer's specifications or clearly personalised. (...) »

To exercise their right to withdrawal for the other products, the Customer must, within the aforementioned period, send a recorded delivery letter with acknowledgement of receipt to Terre-De-Bougies stating their wish to exercise this right, or to return the "exercise the right to withdrawal" form to the address shown in article 13 of these Terms and Conditions of Sale.

The customer must return the products to the address shown in article 13 of these Terms and Conditions of Sale within fourteen (14) days of the communication of their decision to withdraw. The products must be in perfect condition and in the original packaging, free of marks and stains, with all the accessories (including the instructions) and any free gifts received.

They must return the product with a copy of the invoice as well the "return form" duly completed. The risks and costs of returning the products remain the responsibility of the Customer. If all the conditions required for the return of products are not met, Terre-De-Bougies may make deductions from the amount to be refunded, where applicable, a percentage of the retail price corresponding to the retail price of the missing products, as well as the cost of repair, replacement and/or refurbishment of products which may have been damaged.

Terre-De-Bougies agrees to refund the Customer within a period of fourteen (14) days from receipt of the recorded delivery letter, stating the Customer's wish to withdraw, or of the withdrawal form. Nevertheless, Terre-De-Bougies has the right to defer the refund until the products are actually received.

The refund will be made directly to the Customer's bank account, using the same procedures as those used for the payment of the products in question.

All returns must first be notified to the Custome Service of the TERRE DE BOUGIES company by returning the following form, fully completed, by post or email: Right to withdrawal form

 

Customer files

In accordance with the French law 78-17 of 6 January 1978 relating to individual liberties and the computer processing of data, you have a right to access computer data that you have communicated to us and to have such data rectified. Such information is purely for the internal use of the company LAB SAS.
 

Applicable law


The contractual information is presented in the French language and the products offered for sale comply with French regulations. Where applicable, foreign customers should check the options for use of the product they are planning to order with their local authorities. The LAB SAS company cannot be deemed liable for failure to respect the regulations of a foreign country.

These terms and conditions of sale are subject to French law. In the event of a persistent dispute on the application, interpretation and execution of these terms and conditions, and failure to arrive at a mutual agreement, any dispute will be dealt with by the competent French courts.
